Assisting Injured Law Enforcement Officers With Workers’ Compensation Needs

Serious back injuries can derail the career of a dedicated law enforcement officer. These injuries are common and often debilitating. When they happen in the line of duty, officers may be entitled to workers’ compensation benefits to cover their lost wages, high medical costs and a permanent disability award.

Here at Hannegan & Tafreshi Injury Law, P.C., we are carrying on the legacy of lawyer Kenneth Hannegan, a retired California Highway Patrol (CHP) officer.  Our office is uniquely qualified to assist others who had been injured while serving their community.  We have a compassionate team that is firmly dedicated to helping officers protect their rights and obtain the workers’ compensation benefits they deserve.

Duty Belt Back Injuries

There are many ways that law enforcement officers can suffer back injuries, from car accidents to back strains that develop during the course and scope of their employment, while performing their usual, customary, repetitive, and strenuous job duties, while on active duty.

For example, there is a unique presumption that applies to peace officers who wear duty belts, which they use to carry items like guns, handcuffs, flashlights and more. These heavy belts have caused back injuries so often that California Labor Code Section 3213.2 specifically applies a presumptive lower back compensable injury.

This applies to officers who have been employed for five or more years, if they were working in a full-time position and were on salary. Most duty belts qualify unless they have been modified in such a way that the officer has not carried the expected equipment.

Other Presumptive Injuries Applicable To Peace Officers

Please contact our office to discuss office other presumptive injuries that apply to “Safety Officers,” including but not limited to: Heart Trouble, Hernia, Pneumonia, Cancer, Tuberculosis, Blood Borne Infectious disease, Exposure to Biochemical Substances, Meningitis, Lyme Disease, and Post-Traumatic Stress Disorder.
